Disclose or Not?

Clients want to sell their home, but the neighbor across the street is apparently throwing garbage in his (the neighbor’s yard) to make the home less attractive to potential buyers.  I do not make this up.  Does the client have to disclose this situation to prospective buyers?  My answer is no, as a seller must disclose only those items not readily observable by a prospective buyer, which matters materially impact the value of the home.  A buyer can see the condition of the home across the street so there is no issue, and nothing need be disclosed as to this matter in a contract for sale.
