Florida’s penalties concerning methamphetamine

Methamphetamine is a huge problem in Florida. It takes the lives of hundreds every year. Involvement with the drug is illegal in our state and punishable by time in prison and fines. Here, we will detail the penalties that you could be facing for possession, manufacture and trafficking of meth.

Possession

Methamphetamine is a Schedule II drug in Florida, meaning that it has a high potential for abuse leading to dependence with severe restrictions on its medical use. This means that possession of methamphetamine is a third-degree felony. It is punishable by 5 years in prison and a fine of $5,000.

To be found in the possession of chemicals intended to manufacture meth or to give to someone else to manufacture meth is precursor possession, which is a second-degree felony. This is punishable by up to 15 years in prison and a fine of $10,000.

You may, however, legally possess meth with a valid prescription from a physician or pharmacist.

Manufacture and trafficking

Trafficking methamphetamine measuring 14 grams or more is a first-degree felony. This can include selling, buying, manufacturing, delivering or possessing the substance. The punishment is reliant on the amount of the drug found.

  • 14 grams or more is punishable by three years in prison and a minimum fine of $50,000.
  • 28 grams or more is punishable by seven years in prison and a minimum fine of $100,000.
  • 200 grams or more is punishable by 15 years in prison and a minimum fine of $250,000.
  • 400 grams or more is a capital felony because it can lead to death. It is punishable by death or life in prison and a minimum fine of $250,000.

Methamphetamine and children

The manufacture of methamphetamine or precursor possession is a first-degree felony when it involves a child. If a child under 16 years old is present, there is a minimum 5 years in prison. If a child under 16 years old suffers bodily harm because of the possession or manufacture, there is a minimum 10 years in prison.
